The Biden administration warned Supreme Court justices on Monday that hundreds of thousands of deportation cases could be reset and sent back to the immigration system if they rule against the administration in a key case over the use of immigration notifications.
A Notice to Appear is an order issued to the Immigration Court before an illegal immigrant is released to the mainland. However, sometimes these documents are released without a court date and simply read “TBD.” In this case, a separate court date will be mailed to the illegal immigrant at a later date. If immigrants fail to show up for a hearing, they may be ordered deported “in absentia.” Lawyers representing illegal immigrants argue that such separate mailings do not count as proper notice under the law. Government lawyers argue that this practice does count as proper notice and warn that hundreds of thousands of people who received TBD on the NTA will be allowed to seek review of their cases if the court rules against them . Charles McCloud, representing the government, said the number of absentee deportation orders had increased dramatically during the recent border crisis, from 380 in 2021 to more than 11,000 in 2023. “We are very concerned that these hundreds of thousands of cases could be reinjected into the immigration system,” McLeod told the judges.
